They apply to all orders placed on the Site, to the exclusion of any other conditions, unless OBAÏA PARIS has given its prior written agreement.
The Customer acknowledges having read these T&Cs before confirming their order and accepts them without reservation.
OBAÏA PARIS reserves the right to amend its T&Cs at any time. The applicable conditions are those in force on the date the order is confirmed.
Article 3 — Products offered for sale
The Site offers changing bags, compact bags and accessories designed to support parents in their daily lives.

Its features and any included accessories are specified on its product page.

- Dummy cases;
- Dummy pouches;
- Changing mats;
- Pushchair clips.
These accessories may be sold separately or, where specified on the Site, with certain bags.
3.4 — Changes to the catalogue
OBAÏA PARIS may expand its catalogue with new changing bags, new collections and new accessories.
New products are only offered for sale once they are actually published on the Site.
Product photographs, illustrations and visuals are provided for information purposes. OBAÏA PARIS strives to reproduce the colours and features of its products faithfully, but their appearance may vary depending on screens and display settings.
The essential characteristics of each product are set out on its product page.
Article 4 — Product availability
Product offers are valid while stocks last or, for pre-orders, within the limit of the quantities offered for order.
If a product becomes unavailable after the order has been confirmed, OBAÏA PARIS will inform the Customer as soon as possible.
The Customer may then choose:
- A full refund of the unavailable product;
- An alternative solution offered by OBAÏA PARIS, subject to the Customer’s agreement.
No replacement will be made without the Customer’s agreement.
Article 5 — Prices
Prices displayed on the Site are in euros, including all taxes (VAT included), excluding any delivery charges.
Delivery charges are shown to the Customer before the order is finally confirmed.
OBAÏA PARIS reserves the right to change its prices at any time. However, products will be invoiced at the prices displayed when the order is confirmed.
Promotional codes and commercial offers are subject to their own specific conditions of validity, in particular their duration, any minimum purchase amount and the products concerned.
Unless otherwise stated, promotions cannot be combined.
Article 6 — Orders
The Customer selects the products they wish to buy and adds them to their basket.
Before confirming their order, they can check its details, its total price and the delivery charges, and correct any errors.
Final confirmation of the order implies:
- Acceptance of the contents of the basket;
- Acknowledgement of the obligation to pay;
- Acceptance of these T&Cs.
An order confirmation is sent to the Customer by email once payment has been approved.
OBAÏA PARIS reserves the right to refuse or cancel an order for legitimate reasons, in particular suspected fraud, non-payment or a previous dispute relating to an order.
Article 7 — Payment
Payment is due when the order is placed, including for products offered for pre-order, unless otherwise stated at the time of purchase.
The accepted payment methods are those offered on the Site when the order is confirmed.
Payment is made through secure payment solutions.
The Customer’s bank details are not stored by OBAÏA PARIS.
The order is considered final once the payment provider has confirmed acceptance of the payment.
If payment is declined, the order may be suspended or cancelled.
Article 8 — Delivery

8.2 — Order preparation
Orders for products in stock are prepared and shipped within an indicative period of 1 to 3 working days, excluding weekends and public holidays.
Delivery times then vary according to the destination and the carrier chosen.
8.3 — Indicative delivery times
As an indication, the usual delivery times are as follows:
- Mainland France: 1 to 3 working days;
- Europe and Switzerland: 2 to 5 working days;
- United Kingdom: 2 to 5 working days;
- French overseas territories: 5 to 10 working days;
- Rest of the world: 5 to 10 working days.
These times are indicative and may vary depending on the carrier, the destination, peak periods or circumstances beyond OBAÏA PARIS’s control.
Delivery times given to the Customer when ordering prevail where they are more specific.
8.4 — Delivery tracking
Where the carrier allows it, a tracking number is sent to the Customer by email or by any other available means.
The Customer is invited to follow the progress of their parcel using the information provided.
8.5 — Late delivery
In the event of late delivery, the Customer may contact the after-sales service at: sav@obaiaparis.com.
In accordance with the law, if delivery does not take place on the date or within the period announced, the Customer may ask OBAÏA PARIS to deliver within a reasonable additional period, and then terminate the contract under the conditions laid down in the French Consumer Code (Code de la consommation) if delivery still does not take place.
In the event of a valid termination, the sums paid will be refunded under the conditions provided for by law.
8.6 — Customs duties and formalities
For deliveries outside the European Union, customs duties, local taxes or import charges may be required by the authorities of the destination country.
Any such charges are payable by the Customer, unless otherwise stated when ordering.
Article 9 — Pre-orders
Some products may be offered for pre-order before they are physically in stock.
A pre-order allows the Customer to reserve a product that is being manufactured or sourced.
Products offered for pre-order are clearly identified as such on their product page.
The expected shipping date or period is indicated on the product page and/or during the ordering process.
For the pre-orders currently offered, shipping is scheduled from 30 November 2026, with delivery estimated in early December 2026 depending on the destination.
This period is an estimate and may change in the event of manufacturing or transport difficulties or circumstances beyond OBAÏA PARIS’s control. Any significant change will be communicated to the Customer.
The Customer is informed that payment for a pre-order is due when the order is placed, according to the terms displayed on the Site.
If a pre-order definitively cannot be fulfilled, OBAÏA PARIS will inform the Customer and refund in full the sums paid for the product concerned.
Orders containing both in-stock and pre-order products
Unless otherwise stated at the time of ordering or specifically agreed with the Customer, an order containing both products available immediately and pre-order products may be shipped in a single parcel once all the products are available.
Any specific delivery conditions displayed when ordering prevail.
The right of withdrawal applies to pre-orders under the conditions provided for by law. Buying a product on pre-order does not remove this right.
Article 10 — Right of withdrawal
10.1 — Legal period
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the consumer Customer has fourteen (14) calendar days to exercise their right of withdrawal, without having to give any reason.
For an order of goods, the period starts on the day after the product is received by the Customer or by a third party designated by them, other than the carrier.
Where the order covers several goods delivered separately, the period starts on receipt of the last item.
10.2 — How to exercise the right
The Customer may exercise their right of withdrawal:
- Using the free online withdrawal feature available on the Site;
- By email to sav@obaiaparis.com;
- Using the model withdrawal form appended to these T&Cs;
- By post to the registered office of OBAÏA PARIS.
The statement must clearly express the Customer’s decision to withdraw and be sent before the legal period expires.
Where the request is made by email or through the online feature, OBAÏA PARIS sends the Customer an acknowledgement of receipt on a durable medium.
10.3 — Returning products
After communicating their decision to withdraw, the Customer has a further fourteen (14) days to return the products concerned.
Products must be sent back to the return address provided by the after-sales service.
The Customer may only handle the products to the extent necessary to establish their nature, characteristics and proper functioning, as they could in a shop.
The Customer may be held liable for any loss in value of the product resulting from excessive handling.
Products must be returned with their accessories and included items and, where possible, in their original packaging. The absence of the original packaging does not, on its own, automatically exclude the right of withdrawal.
10.4 — Return costs
The direct costs of returning the products are borne by the Customer exercising their right of withdrawal, unless otherwise stated by OBAÏA PARIS or provided for by a legal provision more favourable to the Customer.
10.5 — Legal exceptions
The right of withdrawal does not apply to products covered by the exceptions set out in Article L.221-28 of the French Consumer Code, in particular goods made to the consumer’s specifications or clearly personalised.
Products that are simply offered as a limited edition, on pre-order or in limited quantities are not excluded from the right of withdrawal for that reason alone.
Article 11 — Returns and defective products
For any request concerning a return, a product received damaged, a wrong item or a missing item, the Customer may contact the after-sales service at: sav@obaiaparis.com.
To help us process the request, the Customer is invited to provide:
- Their order number;
- A description of the problem;
- Photographs of the product or parcel where useful.
OBAÏA PARIS will review the request and tell the Customer how to proceed.
No internal reporting deadline may deprive the Customer of their rights under the legal guarantees.
If a product is non-conforming or defective, the Customer’s rights are those provided by the legal guarantees described in Article 13.
Article 12 — Refunds
If the right of withdrawal is validly exercised, OBAÏA PARIS refunds the Customer all sums paid, including the initial standard delivery charges, under the conditions provided for by law.
Any additional costs resulting from the Customer choosing a delivery method more expensive than the standard method offered are not refunded.
The refund is made no later than fourteen (14) days from the date on which OBAÏA PARIS is informed of the decision to withdraw.
However, OBAÏA PARIS may withhold the refund until the products have been received back or until the Customer has supplied proof of having sent them, whichever is earlier.
The refund is made using the same payment method as the one used for the order, unless the Customer expressly agrees to another method and provided that it does not incur any fees for them.
If OBAÏA PARIS cancels an order or it definitively cannot be fulfilled, the sums paid for the products concerned are refunded in full.
Article 13 — Legal guarantees
Products sold by OBAÏA PARIS benefit from the applicable legal guarantees. These guarantees are mandatory and cannot be removed or reduced by these T&Cs.
13.1 — Legal guarantee of conformity
In accordance with Articles L.217-3 et seq. of the French Consumer Code, the Customer benefits from the legal guarantee of conformity for two (2) years from delivery of the goods.
This guarantee covers in particular lack of conformity existing at the time the product is delivered, including manufacturing defects or differences from the contractually stated characteristics.
For new goods, any lack of conformity that appears within twenty-four (24) months of delivery is presumed to have existed at the time of delivery, unless proven otherwise or incompatible with the nature of the defect.
The guarantee entitles the Customer to have the product brought into conformity by repair or replacement, under the conditions provided for by law.
If bringing the product into conformity is impossible or does not take place under the legal conditions, the Customer may obtain a price reduction or termination of the contract.
13.2 — Legal guarantee against hidden defects
In accordance with Articles 1641 et seq. of the French Civil Code, the Customer benefits from the legal guarantee against hidden defects.
This guarantee only applies to hidden defects in the product, existing at the time of sale, which make the product unfit for its intended use or which reduce that use so much that the Customer would not have bought it, or would have paid a lower price, had they known of them.
In accordance with Article 1648 of the French Civil Code, any action for hidden defects must be brought within two (2) years of discovering the defect, within the applicable legal long-stop period, in particular twenty (20) years from the sale.
It is for the Customer invoking this guarantee to provide evidence establishing the existence of the defect, its hidden nature, its seriousness and the fact that it existed before the sale.
Deterioration resulting from normal wear and tear, intensive use, misuse, overloading, lack of care, an accident or unauthorised repair does not, on its own, constitute a hidden defect.
In the event of a claim, OBAÏA PARIS may ask the Customer for any information or supporting documents useful for examining the product and determining the origin of the defect.
This provision in no way limits the legal guarantees from which the Customer benefits.
13.3 — Making a guarantee claim
Any request relating to a legal guarantee must be sent to the after-sales service at sav@obaiaparis.com.
The Customer is invited to specify:
- Their order number or proof of purchase;
- The product concerned;
- The nature of the defect observed;
- The date on which the defect was observed;
- Photographs or any other information useful for examining the claim.
OBAÏA PARIS may ask for the product to be presented or returned so that it can be examined, under the conditions provided for by law.
The nature of the defect and the solution provided will be determined in light of the circumstances and the applicable legal provisions.
13.4 — Legal information on the guarantee of conformity
The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:
- The trader refuses to repair or replace the goods;
- The goods are repaired or replaced after a period of thirty days;
- The repair or replacement of the goods causes major inconvenience to the consumer;
- The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights mentioned above result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover, in accordance with Article L.241-5 of the French Consumer Code.
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect, within the legal long-stop period. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.
Article 14 — Use and care of products
The Customer undertakes to use the products in accordance with their intended purpose and with any use and care recommendations provided with the product or on its product page.
Bags and accessories must be used under normal and reasonable conditions.
Pushchair clips are accessories for carrying and attaching the bag. They are not a child safety device.
The Customer must make sure that the bag is properly attached, does not hinder the handling of the pushchair and does not compromise its stability.
Changing mats and accessories do not replace constant adult supervision. A baby must never be left unattended on a changing mat or any other changing surface.
OBAÏA PARIS cannot be held liable for damage resulting from improper use of the products, subject to the applicable mandatory legal provisions.
Article 15 — Liability
OBAÏA PARIS is responsible for the proper performance of the obligations arising from the sales contract, under the conditions provided for by law.
However, it cannot be held liable in the event of misuse of the product by the Customer, failure to follow care or use recommendations, or damage resulting from an external event attributable to the Customer.
OBAÏA PARIS cannot be held liable for delays or failures to perform due to an event of force majeure within the meaning of Article 1218 of the French Civil Code, subject to the Customer’s rights under the law.
Article 16 — Intellectual property
All elements on the Site, in particular texts, photographs, visuals, illustrations, logos, graphics, creations, collection names, trademarks and design elements, are protected by intellectual property law.
These elements are the exclusive property of OBAÏA PARIS or are used under licence.
Any reproduction, representation, distribution, adaptation or use, in whole or in part, without the prior written consent of OBAÏA PARIS, is prohibited.
Article 17 — Personal data
In the course of its business, OBAÏA PARIS collects and processes certain personal data needed to manage orders, payments, deliveries, after-sales service and customer relations.
Data is processed in accordance with the applicable data protection regulations, in particular the General Data Protection Regulation (GDPR).
The Customer may exercise their rights of access, rectification, erasure, restriction and objection, under the conditions laid down by the regulations.
For any request relating to their personal data, the Customer may contact:
contact@obaiaparis.com
Detailed information on data processing, cookies and users’ rights is set out in the Privacy Policy available on the Site.
Article 18 — Archiving and evidence
The computerised records kept in the systems of OBAÏA PARIS and its service providers under reasonable security conditions will be considered as evidence of the communications, orders and payments made between the parties.
In accordance with the law, contracts concluded electronically for an amount of €120 or more are archived for the legal period of ten (10) years.
The Customer may request access to the information relating to their order by contacting customer service.
Article 19 — Customer service
For any question about a product, an order, a delivery, a return or a complaint, the Customer may contact OBAÏA PARIS:
After-sales service: sav@obaiaparis.com
General enquiries: contact@obaiaparis.com
OBAÏA PARIS will endeavour to respond as quickly as possible.
Article 20 — Consumer mediation
In the event of a difficulty or dispute relating to an order, the Customer is invited to contact OBAÏA PARIS first in order to seek an amicable solution.
A prior written complaint to OBAÏA PARIS is required before referring the matter to the consumer mediator.
In accordance with Articles L.612-1 et seq. of the French Consumer Code, if the dispute is not resolved amicably, the consumer Customer may refer it free of charge to the consumer mediator of which OBAÏA PARIS is a member:

The Customer may refer the matter to the mediator within one year of their written complaint to OBAÏA PARIS, subject to the admissibility conditions laid down by the regulations.
The Customer remains free to accept or refuse the solution proposed by the mediator and may, at any time, choose to go to court.
Article 21 — Governing law and disputes
These T&Cs are governed by French law.
In the event of a dispute, the Customer is invited to seek an amicable solution with OBAÏA PARIS and, where appropriate, to use consumer mediation under the conditions set out in Article 20.
If no amicable solution is found, the dispute may be brought before the competent courts in accordance with the applicable legal rules, in particular those protecting consumers.
Article 22 — Partial invalidity
If any provision of these T&Cs is declared null, unlawful or unenforceable, the other provisions shall remain in full force and effect.
The provision concerned shall then be interpreted or replaced to the extent permitted by law, so as to preserve as far as possible the original intention of the parties.
Article 23 — Language
These T&Cs are written in French.
If they are translated into another language, only the French version shall prevail in the event of any contradiction or difficulty of interpretation, subject to the mandatory provisions applicable to consumers.
